The use of this online shop is subject to the following terms and conditions. By using this website, you agree to these terms and conditions.
Terms and Conditions:
1.1 In these T&Cs:
“Theda-Threads®” means the registered trademarked brand held by OSGas Pty Ltd (ABN 64 101 578 081).
“OSGas Pty Ltd” means the seller of the brand, Theda-Threads®, will be henceforth referred to as “We/Us/Our”.
“Customer” means buyer of items/goods sold by Theda-Threads®, will be henceforth referred to as “You”.
“Goods” means all items or goods (threads, knitwear, bags) sold by OSGas Pty Ltd to the Customer.
“Online Store” means the online store selling items/goods branded Theda-Threads®.
“Market” means the markets where Theda-Threads® may sell at.
“T&Cs” means these terms and conditions of sale.
2.1 These are the terms and conditions also referred to in the purchase order/checkout page.
2.2 These T&Cs apply to all sales of Theda-Threads® branded Goods by OSGas Pty Ltd.
2.3 The Online Store is available to you to be browsed in compliance to these T&Cs.
2.4 You may not distribute, modify, transmit, publish or repost from this Online Store.
3.1 While every effort has been made that the information contained is accurate, all sales are subject to prior sales and sufficient remaining stock
3.2 Orders are placed through the Online Store.
3.3 Orders are also accepted by telephone, email or in person.
3.4We reserve the right to cancel orders.
3.5 In case there are problems with the order, we will inform you and offer an alternative choice. You can then decide if you want to accept this or other alternatives, want to reduce the order or cancel it. Any payments which have been received for such orders will be refunded at once in case cancellation or the difference refunded or invoiced.
4.1 Prices of Goods listed in the Online Store are correct at time of order.
4.2 Prices of Goods may vary between the Online Store and Market.
4.3 Prices of Goods and Postage are subject to change without notice.
5.1 Payment through the Online Store can be made via Paypal (credit card), bank transfer or cheque.
5.2 The full balance of the payment must be made, received and cleared before the order placed is shipped.
5.3 Payment at markets will be either in cash or credit card via Paypal made at the time of purchase.
5.4 Failure to pay by the Customer or failure to receive Payment by OSGas Pty Ltd will result in orders not being processed.
6.1 Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law.
6.2 You are entitled to a replacement or refund for major failure and for compensation for any other reasonably foreseeable loss or damage.
6.3 You are also entitled to have the Good repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits under Return Policy are in addition to other rights and remedies under a law in relation to the Goods.
7.1 It is the condition of use of this online shop to agree that liability of OSGas Pty Ltd is limited to the value of the purchased items.
7.2 OSGas Pty Ltd is not accepting any liability other than refund or replacement or credit of purchased goods.
8. Shipping Details/Postage
8.1 We ship to Australia, New Zealand, Germany, Canada, United Kingdom, United States of America, South Korea, Japan and Sweden. Please contact us by email if we do not ship to your country.
8.2 Your Goods will be shipped after We receive your payment into our account or received cleared funds in case of payment by cheque.
8.3 Postage is calculated by dimension per weight and by country, and as mentioned in 4.3 may be subject to change without notice. If you would like to choose an alternative option of postage, please contact us.
8.4 We ship at least
once a week (Wednesday) and all orders will be shipped within a week
of receiving payment. Depending on orders and available time, we
endeavour to pack and send orders more frequently. Shipping of masks will occur same day or next day.
8.5Orders will be appropriately packaged for shipment.
8.6 When the Goods are shipped the risk of transport and loss is with You, the customer.
9.1 We warrant the quality of our threads, masks, knitwear and bags, and should there be reasons for complains we will handle such complaint according to the return policy as listed under Section 10.
10. Returning Policy
While we have stringent quality requirements on our threads, masks, knitwear and bags, and check for obvious defects before shipment, it will happen in exceptional cases that there will be product defects which did not find our attention.
10.1 Please check content of deliveries upon arrival and report any discrepancies in quantity or colour within 3 weeks and in quality within 3 months by email to us.
10.2 Before sending the Goods back, please contact us by email.
10.3 Please advise Us the reason of return and the requested remedy, replacement, credit or exchange. We will review the return and inform You if we accept the return.
10.4 All products shall be returned to use at: OSGas Pty Ltd., Embroidery & Sewing Division, PO Box 132, Kenmore, QLD 4069 at Your’s, the customer’s, expense.
11.1 OSGas Pty Ltd will collect and store private information of the Customer in order to be able to write invoices and ship the Goods.
11.2 Any private information is stored with the invoices and on the secure service for business documentation only.
11.3 OSGas Pty Ltd will not give out private information to anybody unless legally required.
11.4 OSGas Pty Ltd do not forward private information to other businesses.
